The short answer

Kalshi is a real, federally registered exchange. The CFTC designated KalshiEX LLC as a contract market in 2020 and registered its clearinghouse, Kalshi Klear LLC, in 2024.[1],[3] What is not settled is whether states can regulate its sports contracts as gambling. Federal appeals courts have split on that question, and New Jersey has asked the US Supreme Court to decide it. The Court had not agreed to hear the case as of October 15, 2026.[5]

Kalshi’s federal registrations

Both are listed on the CFTC’s public registry, where anyone can check their current status.

EntityRoleCFTC record
KalshiEX LLCThe exchange (designated contract market)Designated November 3, 2020. Order amended January 17, 2025 to permit intermediated futures trading.[1],[2]
Kalshi Klear LLCThe clearinghouse (derivatives clearing organization)Registered August 28, 2024. Amended order of April 15, 2026 permits clearing futures, options on futures and swaps.[3],[4]

The election contract case Kalshi won

In September 2023 the CFTC blocked Kalshi from listing contracts on which party would control Congress, finding they involved gaming and activity unlawful under state law.[6] Kalshi sued. A federal district court ruled for Kalshi in September 2024, and the D.C. Circuit refused the CFTC’s request to pause that ruling while it appealed.[7]

In May 2025 the CFTC voted to drop the appeal, and the court dismissed it on May 7, 2025, leaving the ruling in Kalshi’s favor in place.[7],[8]

The fight over sports contracts

After Kalshi began offering sports contracts, state gambling regulators sent it cease-and-desist letters.[9],[10] Kalshi’s position is that its contracts are swaps traded on a federally registered exchange, so the CFTC alone regulates them. The states’ position is that they are sports wagers that need a state license. These are the main cases so far. Every ruling in them is at the preliminary injunction stage, not a final judgment:

CourtStateDateOutcome
Third CircuitNew JerseyApril 6, 2026For Kalshi. Affirmed an injunction stopping New Jersey from enforcing its gambling laws, finding Kalshi likely to win on federal preemption. New Jersey has asked the Supreme Court to review it.[5],[10]
Ninth CircuitNevadaAugust 28, 2026For Nevada. Upheld lifting Kalshi’s injunction, holding its sports contracts are not swaps under federal law. Sent Kalshi’s election contracts back to the lower court.[11],[12]
Sixth CircuitOhio and TennesseeSeptember 25, 2026For the states. Held the sports contracts are not swaps and that, even if they were, federal law does not preempt state gambling laws. Kalshi asked the full court to rehear the case on October 9, 2026.[9],[14]
Fourth CircuitMarylandArgued May 7, 2026Pending. Kalshi is appealing an August 1, 2025 ruling that denied it a preliminary injunction. Maryland gave written assurance that it would not enforce its gambling laws against Kalshi while the appeal is pending.[15],[16],[17]
Massachusetts state courtsMassachusettsInjunction January 20, 2026A state court ordered Kalshi to stop offering sports contracts in Massachusetts. An appeals justice paused that order on February 17, 2026 while Kalshi appeals, and the case is now before the Supreme Judicial Court.[18],[19]

The rulings have practical effects. Reuters reported in August 2026 that Nevada’s gaming regulator sought penalties of $120,000 a day over Kalshi’s alleged failure to comply with a court-ordered geofencing deadline. Kalshi said it had hired a Nevada-licensed geolocation vendor and accused the state’s investigators of misrepresenting where they lived.[13]

At the Supreme Court, New Jersey filed its petition on September 2, 2026 (Flaherty v. KalshiEX, No. 26-299). Ohio, 38 other states and the District of Columbia filed a brief supporting review, and Kalshi’s response is due November 9, 2026.[5]

Where the CFTC stands

The CFTC’s position is that it alone regulates prediction markets. In an April 2026 brief to the Massachusetts Supreme Judicial Court it said it has exclusive jurisdiction over them, and its release says it has also sued Arizona, Connecticut, Illinois and New York over state regulation of them.[19]

It is also writing rules. In June 2026 it proposed a framework for reviewing, contract by contract, event contracts that involve gaming and other activities listed in the law.[20] On October 9, 2026 it proposed defining “swap” to expressly include event contracts on sports, politics, culture and weather, the same question the appeals courts have split on.[21] Kalshi cited these rulemakings in its request for the Sixth Circuit to rehear its case.[14]

What this means if you use Kalshi

  • Availability can depend on your state, especially for sports contracts. Check what Kalshi’s app offers where you are rather than relying on a national headline.
  • Read each market’s rules. They name the official source and the exact criteria for how the market settles.
  • You can lose the full amount you pay for a contract. A contract that resolves against you pays $0.
  • Watch the open cases. The Supreme Court petition, the Fourth Circuit appeal and the Massachusetts appeal could each change where sports contracts are offered.

On the business side, Bloomberg reported that Kalshi raised $1 billion at a $22 billion valuation in May 2026.[22] For how the product itself works, see What is Kalshi?

Common questions

Is Kalshi legit?

Kalshi is a real exchange with federal registrations on the public record. The CFTC designated KalshiEX LLC as a contract market in 2020 and registered Kalshi Klear LLC as a clearinghouse in 2024. What is unsettled is whether states can regulate its sports contracts as gambling. This is not legal advice.[1],[3],[5]

Is Kalshi legal in the US?

Kalshi holds CFTC registrations, and the CFTC has said in court filings that it has exclusive jurisdiction over prediction markets. Several states disagree for sports contracts. The Ninth Circuit (Nevada) and Sixth Circuit (Ohio and Tennessee) ruled against Kalshi on that point in 2026, and the Third Circuit (New Jersey) ruled for it. Availability can differ by state, so check Kalshi’s app where you live.[9],[10],[11],[19]

Is Kalshi gambling?

That is the question in court. Kalshi argues its sports contracts are swaps under federal law, regulated only by the CFTC. Nevada, Ohio, Tennessee and other states say they are sports wagers that need a state license. The Ninth and Sixth Circuits found the sports contracts are not swaps. The Third Circuit found Kalshi likely to win on preemption.[9],[10],[11]

Did Kalshi win its case against the CFTC?

Yes, on election contracts. The CFTC blocked Kalshi’s congressional control contracts in September 2023. Kalshi sued, a federal district court ruled for Kalshi in September 2024, and the CFTC dropped its appeal in May 2025. The appeals court dismissed the case on May 7, 2025.[6],[7],[8]

Is the Supreme Court hearing a Kalshi case?

Not yet. New Jersey asked the Supreme Court to review the Third Circuit ruling (Flaherty v. KalshiEX, No. 26-299). The Court has not agreed to hear it. Kalshi’s response is due November 9, 2026, and Ohio, 38 other states and the District of Columbia filed a brief supporting review.[5]

Is Polycopy affiliated with Kalshi?
